Terms of Service

Terms of Service.

The terms governing use of the Recovery Momentum Index™ and its licensing.

Draft · not yet effective · Last updated [effective date]

1. Agreement to these terms

These terms govern your use of the Recovery Momentum Index™ website and the licensing of the framework, offered by [legal entity name] ("Recovery Momentum", "we", "us"). By using this site or licensing the RMI™, you agree to these terms. If you are agreeing on behalf of an organization, you confirm that you are authorized to bind that organization. If you do not agree, please do not use the site or license the framework.

2. The RMI license

A license grants your program the right to use the Recovery Momentum Index™ — an 8-domain, 0–32 whole-person recovery measurement framework (including its eight domains, the Contribution & Service domain, and the associated scoring tools) — within your own recovery program, for the term and on the conditions set out in your licensing agreement.

Licenses are offered in tiers (Foundation, Professional, and Enterprise — see the Licensing page for what each includes). The license is non-exclusive and non-transferable. Unless your agreement expressly says otherwise, you may not:

  • resell, sublicense, or redistribute the framework, the scoring tools, or the domain definitions to a third party;
  • publish the framework as your own, or create a competing or derivative measurement framework from it; or
  • remove or obscure the Recovery Momentum Index™ name or attribution from materials that use it.

Your program remains responsible for how it interprets and acts on RMI scores in its own clinical and operational context.

3. Payment

License fees are quoted per tier; current pricing and what each tier includes are shown on the Licensing page, and a tailored quote is provided when you enquire. Unless your agreement states otherwise, fees are billed in advance for the license term, are payable by the date stated on the invoice, and are exclusive of any applicable taxes, which are your responsibility. Late or non-payment may lead to suspension or termination of the license as set out in your agreement.

4. Refunds & cancellation

This section covers the license only. Either party may cancel a license in accordance with the notice and refund terms set out in your licensing agreement; the standard window is [license refund / cancellation window]. Where a refund applies, it is calculated as described in that agreement. On cancellation or expiry, your right to use the Recovery Momentum Index™ ends and you must stop using the framework and its scoring tools.

5. Intellectual property

"Recovery Momentum Index", "RMI", the eight-domain framework, the scoring tools, the domain definitions, and all content on this site are the property of Recovery Momentum and its licensors. "Recovery Momentum Index™" is a trademark, and the RMI™ name and marks may not be used without our permission except as your license allows.

A license grants you a right to use the framework within your program — it does not transfer ownership of the framework, the marks, or any intellectual property to you. You may not create derivative frameworks from the RMI™ without our written permission.

6. Acceptable use

These acceptable use rules govern how you may use the site and the framework. You agree to use both lawfully, honestly, and only as permitted by these terms and your license. In particular, you agree not to:

  • misuse, disrupt, or attempt to gain unauthorized access to the site or its underlying systems;
  • present RMI™ scores as a medical diagnosis or as a substitute for clinical judgement — the RMI is a coaching and measurement framework, not a diagnostic tool or medical device;
  • reverse-engineer, copy, redistribute, or resell the framework or scoring tools except as your license expressly permits; or
  • use the site or framework in any way that breaks applicable law or infringes the rights of others.

7. Disclaimers & liability

The site and the framework are provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. We do not warrant that the site will be uninterrupted or error-free. To the fullest extent permitted by law, Recovery Momentum is not liable for any indirect, incidental, or consequential loss, and our total liability arising out of or relating to these terms is limited to the fees you paid for the license in the twelve months before the claim arose.

8. Changes & contact

We may update these terms from time to time; material changes will be posted on this page, and your continued use after a change means you accept the updated terms. These terms are governed by the laws of [governing jurisdiction]. Questions about these terms can be sent to [contact address]. For how we handle personal information, see our Privacy Policy.
